AOC-496.2 — Application to expunge a misdemeanour conviction (Kentucky)

What a court checks before this one is granted

• The conviction is a misdemeanour or a violation, and five years have passed since the sentence was served or probation ended.
• The AOC certification goes in with the application, valid for 30 days from the day it reaches you.
• Kentucky charges a filing fee on conviction expungements; the clerk sets the current figure and part of it is refundable if the application fails.

These are the conditions the statute and the state's own guidance set for this form. Whether your record meets them is a legal judgement, and not one I make.

What I do with it

If this is the form you have chosen, $149 gets your answers typed onto it for one case in one court: the caption, the case number, the charge and disposition as you give them, the dates worked out from your dates, and the agency and service list the form asks for.

• Filing fee at the time of filing, set by case type.
• Felony expungement fee $250 if granted, payable in instalments.
• Waiver motion exists if the fees would take your necessities.
