Record restriction — Request for record restriction, made to the prosecuting agency (Georgia)

Georgia routes this through the prosecutor rather than a petition, and the agency supplies its own request form.

This state does not post this one centrally — the court that heard your case hands it out, and the wording differs by county. Ask the clerk of that court for its current version.

What a court checks before this one is granted

For arrests from 1 July 2013 onward there is no application process at all — the prosecuting attorney decides, and you approach that office.
For a misdemeanour conviction the Second Chance route under 35-3-37(j) needs four clean years since the sentence ended, and is limited to two in a lifetime.
A felony conviction has no equivalent route. Saying that plainly is worth more than a form.
The agency may charge up to $50 to process the request, and the state database charges its own fee.
